This essay will be limited only to critically accessing the substantive provisions of the council of Europe on cybercrime regarding the nature of forms which should attract criminal sanctions. The growing rapid development of computer technology has led to the evolvement of various crimes on the internet. The growing rate of cybercrime and the need to have a unified legislation seem to be the motivating factor that led the forty-three members of the council of Europe to drafting the first international treaty on cyber-crime. Some nations outside Europe had been admitted as observers to the council of Europe. These nations include Canada, Japan, United States of America and South Africa. The United States represented by the Department of Justice (DOJ), played a very significant role in the drafting stages of the convention, even though it was only an observer member to the Council of Europe.
