Construction Burglary Offence

The initial stage in the construction of a Wigmorian chart is to devise an “Ultimate Probandum” which comprises of the law in relation to the offence committed by the accused. This is essentially the conclusion which the prosecution is attempting to prove and which forms the very first node in the chart. In relation to the case of ‘R v. John Figgis’ the offence of ‘burglary’ had been perpetrated contrary to s.9 (1) (a) Theft Act 1968; which provides 1‘A person is guilty of burglary if he enters any building or part of a buildingas a trespasser and with intent to commit any such offence as is mentioned in subsection (2)’.
