This chapter will consider the role of subsidiarity as a tool for monitoring the jurisdictional limits of the Community legislative competence. It will begin by looking at its definition as a principle employed to delegate executive functions to central institutions where it is practical to do so. Then it will focus at its adoption by the European Community through an assessment of the current mechanisms of judicial review by the Court of Justice as well as the potential of national parliaments to monitor its implementation and exercise.
